Service Terms

About Clark Apostille Services

Clark Apostille Services is a privately owned document facilitation business. We are not a government agency, law firm, consulate, embassy, or foreign receiving authority. We do not provide legal advice or determine whether a document will accomplish a client’s legal purpose in the destination country.

Our role is to coordinate eligible document submissions for apostille or authentication, communicate available status information, and arrange return delivery according to the services specifically listed in the client’s written quote or invoice.

Service Scope

Unless a written quote states otherwise, an apostille coordination service may include an initial document review, preparation of submission materials, coordination with a courier or government office, reasonable status monitoring, receipt of the completed or returned submission, a completion check, and return-shipping coordination.

A document review is preliminary and administrative. It is based on the copy or original provided, information supplied by the client, and requirements reasonably available at the time of review. A preliminary review is not a guarantee that a government office, courier, consulate, embassy, foreign registry, school, court, employer, or other receiving authority will accept or process the document.

Service Exclusions

Clark Apostille Services does not:

Select a notarial act or notarial certificate for a signer when prohibited by law

Verify the legal sufficiency, truth, enforceability, or foreign legal effect of a document

Guarantee that the destination country or receiving authority will accept the document

Guarantee government, courier, carrier, platform, consular, or foreign-office processing times

Guarantee issuance of an apostille or authentication certificate

Correct, alter, backdate, or complete another notary’s certificate

Control postal carriers, couriers, government closures, system outages, foreign customs, or receiving-authority decisions

Provide legal, immigration, tax, corporate, or foreign-law advice

Client Responsibilities

The client is responsible for:

Providing complete, accurate, and current information, including the destination country and intended use

Confirming the receiving authority’s current requirements before ordering

Providing eligible originals or certified copies when required

Reviewing names, dates, signatures, spelling, addresses, corporate titles, and document contents

Selecting the required notarial act or obtaining direction from the document drafter, receiving authority, or an attorney

Responding promptly to requests for documents, approvals, identification, payment, or clarification

Keeping copies of documents and tracking information

Paying new government, courier, notarization, retrieval, shipping, or professional fees when a new submission or correction is required, except where Clark Apostille Services agrees in writing to cover them

2. Third-Party and Client-Supplied Document Disclaimer

Clients may submit documents that were prepared, issued, translated, certified, or notarized by another person or organization. Clark Apostille Services may conduct a preliminary visual and administrative review; however, we do not adopt, warrant, or guarantee the work of an outside notary, translator, document preparer, school official, issuing authority, courier, or other third party.

The commissioned notary who performed a notarization is responsible for the notarial act and certificate completed by that notary. Clark Apostille Services cannot sign, amend, replace, backdate, or otherwise correct another notary’s certificate. If an outside notarization is incomplete or unacceptable, the original notary or a newly commissioned notary may need to complete a lawful correction or perform a new notarization.

Government rejection of a client-supplied or third party-prepared document does not, by itself, establish that Clark Apostille Services failed to perform the coordination services purchased. A corrected or replacement document is treated as a new submission unless Clark Apostille Services agrees otherwise in writing. New professional, government, courier, notarization, retrieval, translation, and shipping charges may apply.

3.Refund and Cancellation Terms

Cancellation before work begins

A client may request cancellation in writing before document review, retrieval, notarization, preparation, courier coordination, shipping-label creation, or other work begins. If no work has begun and no third-party expense has been incurred, the amount paid will be refunded, less any nonrefundable payment-processing charge actually retained by the payment processor, except where prohibited by law.

Cancellation after work begins

Professional service fees compensate Clark Apostille Services for review, preparation, coordination, communication, and administrative work. Once work begins, the professional service fee is earned in proportion to the work completed and may be partially or fully nonrefundable.

Government filing fees, courier charges, document-retrieval fees, notarization fees, translation charges, shipping charges, carrier surcharges, and other third-party expenses are nonrefundable once paid, ordered, scheduled, used, or committed, except when the third party issues a refund.

After submission

Once a document has been delivered or submitted to a courier, government office, issuing authority, notary, translator, carrier, or other third party, cancellation cannot stop work already performed or costs already incurred. Any refund will be limited to unearned professional fees and unused client funds, if any.

Rejection, deficiency, or non-acceptance

A government rejection, deficiency notice, request for additional documentation, or refusal by a foreign receiving authority does not automatically create a right to a full refund. Refund eligibility depends on the reason for the outcome and the work already completed.

If the problem results from a client-supplied document, an outside notarization, incorrect or incomplete client information, a change in government requirements, or a receiving authority’s decision, the original professional service fee and third-party expenses remain nonrefundable. A corrected submission may require a new quote and payment.

If a rejection results solely from a documented administrative or notarial error committed by Clark Apostille Services, we will provide a reasonable correction or refund for the affected Clark Apostille Services fee, as appropriate. Any additional remedy must be confirmed in writing.

Refund method and timing

Approved refunds are issued to the original payment method whenever possible. Processing generally begins within 7–10 business days after approval, but the client’s bank or payment processor may require additional time. Nothing in this policy limits a consumer right that cannot legally be waived.

4. Communication and Response-Time Expectations

Standard business communications are handled Monday through Friday, by appointment, excluding holidays and announced closures. Clark Apostille Services generally responds within 1–2 business days. This is a response target, not a guarantee.

Messages received after business hours, on weekends, or on holidays are treated as received on the next business day. Multiple messages about the same matter do not shorten the response window.

Status updates are provided when meaningful information is available. Government offices, couriers, carriers, and issuing authorities may not provide daily status information. The absence of a new update does not necessarily indicate a problem or delay.

Rush service prioritizes internal handling and courier coordination but does not guarantee immediate replies, government issuance, or carrier delivery. After-hours support must be separately agreed to in writing.

Client-response pauses

Quoted timelines pause while Clark Apostille Services waits for documents, information, approval, identification, payment, or other action from the client. If the client does not respond for 30 calendar days, the matter may be administratively closed. Reopening may require an updated quote and current pricing.

6. Government, Courier, Platform, and Carrier Delays

All processing times are estimates measured from the date Clark Apostille Services receives and accepts all qualifying documents, required information, approvals, and payment. Estimates do not include client response time, document retrieval, correction, translation, customs, or delivery unless specifically stated.

Clark Apostille Services does not control the Texas Secretary of State, other state or federal agencies, county clerks, universities, courts, embassies, consulates, foreign authorities, couriers, online-notary platforms, payment processors, shipping carriers, weather events, closures, outages, customs, or security reviews.

A rush or expedited service means that Clark Apostille Services prioritizes the order and uses the selected available processing method. It does not guarantee a government decision or delivery by a particular date. Clients should not purchase nonrefundable travel, appointments, filing dates, or other commitments based solely on an estimated completion date.

7. Shipping, Completion Verification, and Document Risk

Completed and returned documents are shipped using the service selected or approved by the client. Tracking will be provided when available. The client is responsible for providing a complete and accurate delivery address and for arranging receipt at that address.

When a completion scan or photograph is available, Clark Apostille Services may review it before return shipping. A scan or photograph is not guaranteed unless included in the written quote, and some couriers or government offices may not provide one.

If the client requires written approval of a completion scan before shipment, that requirement must be stated and accepted in writing before the return label is released. Shipping will then be held until approval or until the agreed response deadline expires.

Risk of carrier delay, loss, damage, theft, customs action, or misdelivery is governed by the selected carrier’s terms and any purchased insurance. Clark Apostille Services will reasonably assist with a carrier claim but does not guarantee the carrier’s decision.

8. No Legal Advice and Destination-Country Requirements

Clark Apostille Services provides administrative facilitation and notarial services only. We do not advise clients about the legal effect of a document, draft legal instruments, choose a notarial certificate for a signer, determine whether an apostille is legally sufficient for a transaction, or interpret foreign law.

The client should obtain written requirements from the receiving authority and consult a qualified attorney when the document concerns a power of attorney, corporate ownership, immigration, adoption, litigation, inheritance, real estate, or another legal matter.

Government filing fees, courier charges, document retrieval, translation, shipping, and other third-party costs are additional unless expressly included in the written quote. Any applicable charges will be disclosed before payment or additional work begins.

How the Corporate Apostille Process Works

  1. Document Review
    Email your documents for confirmation, formatting review, and required steps.

  2. Notarization (If Required)
    If a corporate POA or affidavit requires notarization, I offer Remote Online Notary (RON).

  3. State-Level Authentication
    Corporate documents must be properly certified before they are eligible for apostille. I ensure all requirements are met.

  4. Texas Secretary of State Apostille
    I prepare, submit, and obtain the apostille directly from the Texas SOS.

  5. Federal Authentication (If Needed)
    For non-Hague countries, federal authentication may be required. I advise this during review.

  6. Domestic or International Delivery
    Completed documents can be shipped domestically or internationally via FedEx International Priority with tracking.
